A. Registration Obligations

To use certain features of The Lusim, you must create an account and provide accurate, current, and complete information during registration. You agree to:

1. Provide truthful information as requested in the registration form.
2. Maintain and promptly update your information to keep it accurate.

You are responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account. If you suspect unauthorized access, you must immediately notify Luso Agile Digital Solutions. We are not liable for losses resulting from unauthorized use of your credentials.

You may not share, sell, or allow third parties to access your account. Misuse may result in suspension or termination of your account.

B. Electronic Communications

By registering on The Lusim, you consent to receive communications electronically, including updates, security alerts, billing information, and promotional content. You may opt out of promotional emails at any time by following the unsubscribe link or contacting privacy@thelusim.com. Transactional and service-related messages cannot be opted out.

C. Acceptable Use Policy

You agree to use The Lusim in accordance with all applicable laws and ethical standards. Unauthorized or harmful use of the Services is strictly prohibited. You may not:

• Copy, resell, or distribute the Services without written consent.
• Upload or share unlawful, defamatory, or infringing material.
• Interfere with the operation of the Site or any user's access to it.
• Attempt unauthorized access to other users' accounts or our systems.
• Introduce malware, spam, or other harmful technologies.
• Harvest personal data or emails from other users.
• Misrepresent your identity or impersonate others.
• Use the Services to send bulk or unsolicited messages.

We reserve the right to suspend or terminate your access at our sole discretion if you violate these Terms or applicable laws.

D. User Content

You may upload, share, or store files and data ("User Content") within The Lusim. You retain ownership of your User Content but grant Luso Agile Digital Solutions a limited license to host, process, and display it for the purpose of operating the Services.

You are solely responsible for your content, and by uploading it, you confirm that:

• You own or have the necessary rights to use and share it.
• It does not infringe any third-party rights or applicable laws.

We do not claim ownership of your content but reserve the right to remove content that violates these Terms.

E. Intellectual Property

All intellectual property rights in The Lusim — including text, design, software, graphics, logos, and data — belong to Luso Agile Digital Solutions or its licensors. No rights or licenses are granted to you except as expressly stated in these Terms.

You may not:

• Copy, modify, reverse-engineer, or distribute any part of The Lusim platform.
• Use our name, logo, or trademarks without prior written consent.

F. Data Security

We use advanced security measures to protect user data, including AES-256 encryption and secure SSL/TLS connections. Your information is hosted in controlled environments using industry-standard infrastructure. While we strive to protect your data, no system is entirely secure. You use the Services at your own risk.

G. Privacy

Your use of The Lusim is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using the platform, you acknowledge and agree to the terms outlined in the Privacy Policy available at https://thelusim.com/privacy.

H. Warranties and Disclaimer

The Lusim is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding accuracy, reliability, or suitability for a particular purpose. We do not guarantee that the Services will be uninterrupted, secure, or error-free.

You are solely responsible for maintaining backups of your data. We are not liable for any loss of data, interruption of service, or damage resulting from use of the platform.

I. Limitation of Liability

To the maximum extent permitted by law, Luso Agile Digital Solutions and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use or inability to use the Services — including loss of profits, data, or business opportunities.

If liability is determined despite the above limitations, the total amount payable by Luso Agile Digital Solutions shall not exceed the fees paid by you for the one-month period preceding the event giving rise to the claim.

J. Indemnification

You agree to defend, indemnify, and hold harmless Luso Agile Digital Solutions, its affiliates, officers, employees, and agents from any claim, damage, loss, or expense arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

K. Termination

You may terminate your account at any time by contacting privacy@thelusim.com. Upon termination, you may request a copy of your stored data within 30 days. After that period, we may delete your data permanently and without notice.

We reserve the right to suspend or terminate your access if you violate these Terms or misuse the Services.

L. Fees and Payments

Subscription fees and pricing details for The Lusim are published on our Site. We may change our pricing with at least 30 days' notice, sent via email or platform notification.

Unless otherwise stated, subscriptions automatically renew for the same term and billing method. Failure to pay within the required period may result in suspension or deletion of your account.

M. Refund Policy

All subscription fees are non-refundable after the initial 30-day period from your first subscription. If you cancel your account after this period, no prorated refunds will be issued.

N. Governing Law

These Terms shall be governed by and construed under the laws of the Province of Ontario, Canada, without regard to conflict of laws principles. You agree that any disputes shall be exclusively resolved in the courts of Ontario.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in effect. Failure to enforce any right or provision does not constitute a waiver. These Terms constitute the entire agreement between you and Luso Agile Digital Solutions regarding The Lusim.
